Please read these Terms of Use (“Terms”) carefully before using https://www.denisevoight.com or any associated subdomains, platforms, or services (collectively, the “Site”). The Site is owned and operated by Denise Voight, Functional Medicine Nutritionist and Founder of My Spectrum Heroes (“I,” “me,” “my,” or the “Company”).

By accessing or using the Site, purchasing any products (digital or physical), enrolling in any programs, courses, memberships, or consulting services, or otherwise interacting with the content or services offered, you agree to be bound by these Terms. If you do not agree, you must not use the Site or purchase any products or services.

1. Important Health & Wellness Disclaimer

The information provided on this Site—including blog posts, videos, emails, programs, courses, memberships, nutrition recommendations, lab test interpretations, and any other content—is for general educational and informational purposes only. It is not intended to be, and must not be taken as, medical advice, diagnosis, or treatment.

  • Always consult your physician or a qualified healthcare professional before starting any new dietary supplement, nutrition plan, lifestyle change, or health protocol, especially if you or your child have a medical condition, are pregnant, nursing, or taking medication.
  • Nothing on this Site or in any of my programs (including but not limited to the Nutrition Intervention for Autism & ADHD Online Program, functional lab testing packages, or 1-on-1 consulting) constitutes the practice of medicine, psychiatry, psychology, psychotherapy, or any other licensed healthcare profession.
  • Individual results are not guaranteed. Testimonials, case studies, and examples shared on the Site or in marketing materials are not indicative of future results. Your outcomes will depend on many factors outside of my control, including your unique biology, consistency, and implementation.

Use of this Site and any associated products or programs is entirely at your own risk.

2. Nature of Products & Services

I offer:

  • Digital products (courses, memberships, downloadable resources, quizzes, etc.)
  • Physical products (nutritional supplements under the My Spectrum Heroes brand)
  • Consulting and coaching services
  • Functional lab testing recommendations and interpretation (non-diagnostic)

All sales are subject to separate refund policies displayed at the time of purchase. Digital products and program memberships are generally non-refundable after access has been granted, except where required by law.

3. Intellectual Property & License Granted

All content on the Site—including text, graphics, logos, videos, downloadable files, course materials, and program content—is owned by me or licensed to me and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Site and purchased products for your personal, non-commercial use only. You may not copy, reproduce, distribute, create derivative works from, publicly display, sell, resell, or otherwise exploit any content or products for commercial purposes without my prior written permission.

Unauthorized use terminates the license granted herein.

4. User Conduct & Prohibited Actions

You agree not to:

  • Share login credentials or course/program access with others
  • Copy, record, or redistribute any paid content
  • Use the Site for any unlawful purpose or in violation of any local, state, national, or international law
  • Attempt to interfere with the Site’s security or functionality

I reserve the right to terminate or restrict your access to the Site, programs, or memberships at any time, with or without cause or notice.

5. Payments & Subscriptions

Payments are processed through third-party providers (e.g., Stripe, Kajabi, Shopify). You agree to the terms of those providers. Recurring membership fees will continue until you cancel through your account settings or by contacting support.

6. Privacy

Your use of the Site is also governed by my Privacy Policy, available at https://www.denisevoight.com/privacy-policy (or the current URL). By using the Site, you consent to the practices described therein.

7. Third-Party Links & Services

The Site may contain links to third-party websites (e.g., lab testing companies, supplement fulfillment partners, payment processors). I am not responsible for the content, accuracy, or practices of these sites.

8. Disclaimer of Warranties

THE SITE, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

I do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, I, MY COMPANY, EMPLOYEES, CONTRACTORS, OR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES—EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES—ARISING FROM YOUR USE OF THE SITE, PRODUCTS, OR SERVICES.

My total liability to you for any claim shall not exceed the amount you paid me in the preceding 12 months.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless me and my officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your use of the Site, products, or services.

11. Governing Law & Jurisdiction

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Orange County, California.

12. Changes to These Terms

I may update these Terms from time to time. The updated version will be indicated by the “Effective Date” above. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
